Spousal Asset Transfer: Spousal Rollover
In the case of Tenancy in Common (TIC) assets (e.g. joint purchase of a property), when one spouse dies, the assets can be automatically transferred to the other spouse without the need to pay capital gains tax. With this type of "spousal transfer", VAT is not calculated until the second spouse dies.
It is important to note that Joint Tenancy is different from Tenancy in Common, where assets need to be inherited through the probate process and taxes may be incurred.
Owner-occupied housing tax exemption: Principal Residence Exemption
Owner-occupied dwellings are exempt from capital gains tax, and parents leave the main residence to their children as an inheritance when they pass away. After the transfer, if it is the child's own home, the increase in value is also exempt from capital gains tax. If the child already owns other residences, he/she will have to specify one of them as his/her own residence after the inheritance, otherwise the property other than his/her own residence will be subject to VAT.

Small Business Exemption: Small Business Exemption
If one holds shares in a qualifying Canadian Controlled Private Corporation (CCPC) or agricultural assets, these assets are eligible for a tax exemption totaling $1.01 million cumulatively for life (2024) when they are sold after they have appreciated in value. If the appreciation exceeds C$1.01 million, the excess will still be subject to capital gains tax.
Life Insurance Benefits Exemption
Compensation from life insurance is paid tax-free directly to the beneficiaries upon the death of the insured person, and not only are these compensations not subject to VAT, they are also not subject to the court certification process. Insurance settlements can be used directly for inheritance or other financial needs.

Tax Planning Tip:
- Rationalize your asset structure : Avoid unnecessary capital gains tax by holding assets in joint names or identifying the main residence at the time of inheritance
- Take advantage of tax benefits : Spousal asset transfers, small business tax exemptions, and other policies can be used to significantly reduce taxes
- Purchase of life insurance : Provide protection for your family while solving the problem of transferring assets for tax purposes.
